I've raised this very issue with TFGM in the past and they only specify on a school tender the min number of passengers so ie, the vehicle used must be able to carry 38 passengers +, but if a Dart carries 30, purely for example, they get round it by using standee's, but it's always been my opinion that from a safety point of view, not to mention the anti social aspect all passengers on a school service should be able to sit down.
